Terms of Service

Welcome to Fundament. By accessing or using the Fundament application at getfundament.app, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use the service.

1. Description of Service

Fundament is a productivity application for solo builders. It provides a project board, AI-assisted recommendations for the next task, focus timers linked to that task, and weekly reviews and shareable recaps of what was completed. The service is provided as a web application accessible through modern web browsers.

2. Account Registration

To use Fundament, you must sign in with a Google account. You are responsible for maintaining the security of your Google account credentials. You agree to provide accurate information and to not create accounts for fraudulent purposes.

You must be at least 13 years old to use this service. If you are under 18, you must have parental or guardian consent.

You retain ownership of all content you create in Fundament, including focus session notes, goals, reflections, and other personal data. By using the service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you.

You are solely responsible for the content you enter into the application.

5. AI Features

Fundament includes AI-powered features such as coaching and adaptive suggestions. These features are provided for informational and productivity purposes only. AI-generated suggestions should not be considered professional advice (medical, psychological, financial, or otherwise). You use AI features at your own discretion.

Session context shared with AI providers is processed according to their respective privacy policies and does not include personally identifiable information beyond what you enter in your reflections.

6. Beta Access and Future Paid Plans

Beta access. Fundament is currently in beta and is provided free of charge. This includes the focus timer, the project board, AI next-brick recommendations, weekly reviews and recaps, and Ship Buddy. No payment method is collected and no charge is made during the beta.

Paid plans. When the beta ends, continued access to Fundament will require a paid subscription. Pricing and billing terms will be displayed before any payment is taken, and no account will be charged without an explicit purchase. We will give notice by email to registered users before paid plans take effect.

Founding price. Accounts created during the beta will be offered the founding subscription price for their first twelve months of paid access, provided the account remains active and in good standing. Beyond that period, standard pricing applies.

Beta access is provided as-is and may be changed, limited, or discontinued. Features available during the beta are not guaranteed to remain available, or to remain free, once paid plans take effect.

7. Google Calendar Integration

If you choose to connect Google Calendar, Fundament will access your calendar data as described in our Privacy Policy. You can revoke this access at any time through your Google Account settings.

8. Intellectual Property

The Fundament service, including its design, code, features, and branding, is owned by Fundament and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the service without our written permission.

9. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, error-free, or secure. We make no warranties regarding the accuracy of AI-generated content.

10. Limitation of Liability

To the maximum extent permitted by law, Fundament shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service, including loss of data, loss of productivity, or any other intangible losses.

11. Termination

We may suspend or terminate your access to the service at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the service will immediately cease. You may request export of your data before account deletion.

12. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated terms on this page and updating the effective date. Continued use of the service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
